MUNICIPAL ORDINANCE NO. 2020-11

AN ORDINANCE ADOPTING THE GUIDELINES IN THE REGISTRATION AND LICENSING OF NON-RESIDENT FISHERMEN AND FISHING GEAR IN THE MUNICIPALITY OF SAN ESTEBAN, ILOCOS SUR, PROVIDING PENALTIES FOR VIOLATION THEREOF AND FOR OTHER PURPOSES

Be it enacted by the Sangguniang Bayan Members of the Municipality of San Esteban, Ilocos Sur in their Regular Session, that:

SECTION 1 – Title – This Ordinance shall be known as the “An Ordinance adopting the guidelines in the registration and licensing of non-resident fishermen and fishing gear in the Municipality of San Esteban, Ilocos Sur, providing penalties for violation thereof and for other purposes.”

SECTION 2 – Scope – This Ordinance shall cover all non-resident fishermen and fishing gear (hook and line only) which will be used in the municipal waters of San Esteban, Ilocos Sur.

SECTION 3. Policy – It is the policy of the Municipality of San Esteban, Ilocos Sur the proper management, conservation, development protection and utilization of its municipal waters and to regulate the utilization of its coastal and fishery resources.

SECTION 4. – Definition of Terms –

  1. Certificate of Non-Resident Fishermen Registration – means non-resident fishermen is listed in the registry book.
  2. Certificate of Number – serves as proof of identity of fishing gear.
  3. Fishing Gear – refers to “hook and line” instrument for fishing.
  4. Fishing License – refers to a permit to fish within municipal waters granted to non-resident fishermen using specific type of fishing gear.

SECTION 5 – Registration of Non-Resident Fishermen and their Fishing Gear – All non-resident fishermen and fishing gear shall be required to register themselves and their fishing gear which is the “hook and line” only once at any time of the year with the LGU thru the Municipal Agriculture Office before they engage in fishing activities within the municipal waters;

SECTION 6 – Requirements for the Issuance of Certificate of Non-Resident Fishermen –

a. Duly accomplished Standard Registration Form
b. Voter’s Certificate/ID
c. Official Receipt evidencing payment of the corresponding Registration Fee

SECTION 7. Fees – All non-resident fishermen shall pay the corresponding fees at the Treasury Office and the issued permit must be carried at all times when fishing.

  1. Entrance Fee – P10.00 per day in every barangay
  2. Annual Registration Fee P500.00 per fisherman
  3. Fishing Gear (Hook and Line) – P20.00 each

Section 8. That a designated fishing area shall be identified by the Municipal Agriculture Office;

SECTION 9 – IMPLEMENTING AGENCIES –
The Barangay Officials & tanods, bantay dagat, PNP Personnel and the Office of Agriculture shall oversees the proper implementation of this Ordinance and all the guidelines, rules and regulations relative to fishing operation.

SECTION 10 – Prohibited Acts – Non-resident fisherman shall not be allowed to engage in any fishing activity in municipal waters without fishing license certificate and non-payment of corresponding fees. Fishery License certificate issued by the Municipal agriculture Office shall not be transferred to anyone.

SECTION 11 – Sharing – Sharing of proceeds shall be 60% for LGU and 40% for concerned barangay;

SECTION 12. That signage’s shall be installed in the designated area of fishing activities:

SECTION 13 – Penalties – Any person found guilty and violating this ordinance shall be fined according on the following, to wit.
a. 1st offense – a fine of One Thousand Pesos (P1,000.00)
b. 2nd offense – a fine of Two Thousand Pesos (P2,000.00)
c. 3rd offense fine of Two Thousand Five Hundred Pesos (P2500.00), confiscation of fish catch and fishing gear and revocation of license.

SECTION 14. Separability Clause. Any portion or provision of this Ordinance that may be declared unconstitutional shall not have the effect of nullifying its other portions or provisions as long as such remaining portion can still be given effect.

SECTION 15. Repealing Clause. All existing ordinances, Municipal Executive Orders or provisions thereof inconsistent with this ordinance are hereby repealed or modified accordingly.

SECTION 16. Effectivity Clause. – This Municipal Ordinance No. 2020-11 shall take effect upon its approval by the Honorable Members of the Provincial Board of Ilocos Sur.
